These terms apply from the day payments open. Until then the app is a free preview under the same conditions.

1. Who we are

Labelwise is a product of Quiet Cockatoo Pty Ltd (ABN 25 702 904 934). In these terms, "we" and "us" mean Quiet Cockatoo Pty Ltd, and "you" means the person or business using Labelwise. You can reach us at hello@labelwise.com.au.

2. What Labelwise is

  1. Labelwise is a tool. It applies the food labelling rules it cites to the recipe and details you enter, and makes a label from them. The rules it applies, and where each comes from, are listed on our rules page.
  2. Labelwise is not legal, regulatory or food-technology advice. If you want advice, ask your own adviser.
  3. You are responsible for the label you print. Before you use it, check it against your own product, your recipe as you really make it, and your suppliers' specifications.

3. Your account and acceptable use

  1. When accounts exist, each account is for one business.
  2. Don't resell what Labelwise makes as a service to others unless your plan allows it.
  3. Don't use Labelwise for the products it refuses. They are listed on our rules page, under "Scope".

4. Prices and payment

  1. Prices are shown in Australian dollars and include GST.
  2. Stripe processes payments for us.
  3. A single label is refundable within 7 days of purchase if it has never been downloaded.
  4. A subscription can be cancelled at any time. It ends at the end of the period you have paid for.

5. Our commitments

  1. If we learn of an error in how Labelwise applies a labelling rule, we fix it promptly and tell the customers it affects.
  2. The rules we apply are public, on our rules page.

6. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or your rights under them.

7. Liability

  1. To the extent the law allows, our liability is capped at the fees you paid in the 12 months before the claim.
  2. To the extent the law allows, we are not liable for indirect or consequential loss, such as the cost of a product recall, lost sales or a penalty from a regulator.

8. Your data

How we handle your information is set out in our privacy policy.

9. Changes to these terms

We may change these terms. When we do, we post the new terms here with the date they were last updated. If you keep using Labelwise after a change, you accept the changed terms.

10. Governing law

These terms are governed by the laws in force in the State or Territory where Quiet Cockatoo Pty Ltd has its registered office, and the courts of that State or Territory.
